O presente texto trata sobre o prazo de vigência de patentes dentro de uma perspectiva doutrinária e com pesquisa empírica. Aborda como o prazo de vigência de patentes oscilou historicamente no Brasil e exterior, usando exemplos históricos dessa oscilação temporal, até culminar com a harmonização internacional do prazo de vigência de 20 anos via ADPIC (Acordo TRIPS de 1994). Trata também de análise de dados de pesquisa empírica conduzida pelo autor, concluindo ao final tratar-se de um sistema de patentes não preparado para lidar com diferentes e desafiadoras tecnologias que surgiram muito após a idealização do sistema de patentes e, portanto, gerando dissintonias entre o ideal do sistema e como ele vem performando com o passar das décadas.

This text deals with the term of validity of patents within a doctrinal perspective and with empirical research. It discusses how the patent term has fluctuated historically in Brazil and abroad, using historical examples of this time fluctuation, until culminating in the international harmonization of the 20-year term via TRIPS (TRIPS Agreement 1994). It also deals with data analysis of empirical research conducted by the author, concluding at the end that it is a patent system not prepared to deal with different and challenging technologies that arose long after the idealization of the patent system and, therefore, generating disagreements between the ideal of the system and how it has been performing over the decades.

Este texto aborda el término de validez de las patentes dentro de una perspectiva doctrinal y con la investigación empírica. Discute cómo el término de la patente ha fluctuado históricamente en Brasil y en el extranjero, utilizando ejemplos históricos de esta fluctuación de tiempo, hasta culminar en la armonización internacional del plazo de 20 años a través de los ADPIC (Acuerdo sobre los ADPIC 1994). También trata el análisis de datos de investigaciones empíricas realizadas por el autor, concluyendo al final que es un sistema de patentes no preparado para tratar con tecnologías diferentes y desafiantes que surgieron mucho después de la idealización del sistema de patentes y, por lo tanto, generando desacuerdos entre El ideal del sistema y cómo ha funcionado durante décadas.

Ce texte traite de la durée de validité des brevets dans une perspective doctrinale et de la recherche empirique. Il examine comment la durée du brevet a fluctué historiquement au Brésil et à l'étranger, en utilisant des exemples historiques de cette fluctuation temporelle, jusqu'à aboutir à l'harmonisation internationale de la durée de 20 ans via les ADPIC (Accord sur les ADPIC 1994). Il traite également de l'analyse des données de la recherche empirique menée par l'auteur, concluant à la fin qu'il s'agit d'un système de brevets non préparé pour faire face à des technologies différentes et difficiles qui ont surgi longtemps après l'idéalisation du système de brevets et, par conséquent, générant des désaccords entre l'idéal du système et ses performances au fil des décennies.
