The study analyses the Doctrine of Equivalents, combined with the principles recognised mainly in Europe, which seeks to ease the uncertainty and unpredictability existing in industrial property law, more precisely in relation to patents. The Doctrine of Equivalents allows the extension of the scope of protection of a patent where one of the elements of an already patented invention is replaced by another element, without the change affecting the technical solution found. It examines the scope of protection conferred by the patent, the functional purpose and the content of product and process claims, their interpretation, the requirements for applying the doctrine, the AIPPI resolutions, the point in time for determining the existence of equivalents and the relationship with the doctrine of essentiality, drawing on the Epilady, Samsung versus Apple and Müller versus Hilty cases. It records the influence of German law and the absence of an express reference to the doctrine in Portuguese legislation, and maintains the need for normative harmonisation as to the concept of equivalents and the moment of assessing equivalence, for the sake of legal certainty and technical and scientific development.
