The new perspectives for intellectual property law in the light of Creative Commons licences and their contributions to the improvement of Brazilian copyright legislation

Introduction: the socio-cultural development provided by technological resources of digital sharing has widened the capacity of creation and diffusion of information; however, the normative taxation imposed by law nº 9.610/98 (LDA) to the author's rights leads to obstacles to the use of knowledge and cultural divulgation, requiring an effective modernization. Objectives: to examine the effectiveness of the Creative Commons licenses as contributive tools in the process of mastering the Brazilian authorial legislation; to describe the project and the licenses; to explicit the fair use doctrine as a juridical tool to stimulate the legal use of spiritual creations; and to demonstrate, by using statistic data, the impacts seen worldwide regarding the expansion and dissemination of the licenses. Methodology: descriptive and explicative research, using bibliographic sources, the deductive method and a qualitative approach. Results: the theoretical contributions and the statistic elements provided by the Creative Commons Foundation made it possible to see the acceptation and adequation of the licenses to the reality of democratic dissemination of knowledge, ratifying the necessity of improvement of the Brazilian authorial legislation. Conclusion: the licenses act as a stimulus to the society cultural enrichment and to the effectiveness of the social function of intellectual property.
