This article aims to study the right to patent follow-on drugs. The discussion is focused on the possibility of patenting drugs that add little or apparently none therapeutic advance over drugs already on the drug market. From Ronald Dworkin's idea of integrity and Charles Taylor's idea of identity, this article reconstructs the concepts of novelty, inventiveness and industrial application contained in the statute number 9279/96 at the time of its application to the patentability case of follow-on drugs. In conclusion the patentability of such drugs is sustained not only for conventional reasons, but mainly for the reconstruction of the problem taking the ideas exposed in the theoretical framework.
