On novelty in industrial designs

The study examines the alleged prior art resulting from suppositions about an undisclosed but imagined anticipation. It starts from the finding that the same category of novelty applicable to patents applies to industrial designs, contrasting Articles 96 and 99 of Law No. 9,279/96 with Articles 11, 16 and 17 of the same statute and gathering judicial precedents. It covers the notion of novelty as a general requirement, the absence of degrees of novelty and its concrete and factual character, as well as the state of the art, the public domain, absolute novelty and objective novelty. It then addresses the notion of anticipation: date, admissible evidence, sufficiency of disclosure, entirety and publicity, and the exceptions to the state of the art. The final part deals with the novelty of industrial designs and the conditions under which resistance to disclosure is effective, distinguishing the subjective from the objective element of secrecy. It holds that the circulation of the corpus mechanicum, or of documents disclosing the technology, defeats novelty, save where a duty of confidentiality exists, concluding that the mere public use of a creation does not destroy novelty when it does not disclose the information in a public, entire and sufficient manner.
