Abstract

Intellectual property rights and competition law have the purpose of safeguarding constitutional interests. They are both institutes that, as a rule, coexist peacefully and act as a tool for economic and competition development. These institutes also play a role in providing access to new technologies and products. Notwithstanding, in specific situations, conflicts may arise from the coexistence between intellectual property and competition rights. In this paper we will discuss some of the situations which may cause conflicts between intellectual property and competition rights and also former decisions relating to these matters, within the scope of licensing.
