Abstract

The paper reflects on the valorization by private law of works coming from intangible cultural heritage. Traditionally, the law provides normative solutions of public law for the conservation and dynamization of intangible heritage assets. This article recalls the importance of certain tools of private law, namely copyright, for the protection of intangible cultural heritage. To illustrate this idea, it analyses the recent recognition by UNESCO of the festival of the «Fallas» of Valencia as an Intangible Cultural Heritage of Humanity and its relation with copyright.
