The pharmaceutical sector has undergone and is still undergoing a reshaping in the face of new industrial challenges around the world and especially after the introduction of the TRIPS Agreement within the WTO. The purpose of this article is to provide a brief overview of the TRIPS Agreement and access to medicines, focusing on the critical analysis of how intellectual property rights can increase the cost of medicines through TRIPS-plus measures in domestic law, and on the advantages obtained by developed countries in post-TRIPS bilateralism.
