Copyright, music and technology: a legal reflection on their reconciliation

Abstract

The emergence of new technological tools has posed a considerable challenge to be faced by the media. The quick and easy access to the breadth of content offered to users through the virtual environment, allowing the reach and storage of a very large number of works or creations of any kind, has been broadening the possibilities of reproduction of works protected by copyright, thus generating unrest in the legal field. This study deals with the legal nature of copyright in music in Brazil. It analyses the market of unsold music and the effects of technology on its distribution. It proposes a re-discussion of Law No. 9,610/1998, which governs the matter. The deductive research method was used, in theoretical and qualitative research, with the use of bibliographical materials and legal documents. The constant development of the media makes clear the degree of importance that modern means of interaction have on the coexistence of individuals and the economic impacts arising from it.
