Controversial aspects of intellectual property in the digital age

Abstract

Intellectual Property acts as a sphere of knowledge embodied in the materialization of the guarantee of human creation, through the attribution of rights of appropriation by man over his creations, works or productions. Through this work it is intended to reach the advantages and difficulties found in the current laws, the nature, genera and species of intellectual creations that may be protected and the respective Intellectual Property rights. The controversy over the right to property in the face of artificial intelligence will also be addressed. To that end, on the basis of an exploratory methodology of descriptive character and of specialized bibliography on the subject, patented innovations are observed which drive the development processes and the source of income of countries. Copyright, therefore, may be understood as an institute clothed in a duality of interests: private interests, based on the exercise of freedom of expression and on the author's desire to be rewarded as a result of his intellectual creation, and interests that benefit the growth of the cultural heritage of the whole society through the use of works and technologies deriving from artificial intelligence.
