The fundamental right of the author and the protection of intellectual creation

Human Rights the way we know them today, founded through Declarations, International Treaties and in the State Constitutions, are the result of a long evolutive-historical process which has guaranteed greater security to individuals, as long as these are considered not only citizens of a country but of the world. An aggression to a Fundamental Right is no longer a concern only for the State but for the whole international community. A kind of Human Rights which has been gaining attention in legal discussions is Copyright, which protects the creation of the work, giving stability and security to creators in the development of their intellectual activity. However, the excessive commercial protection which has been given to these Rights and has been spread by the doctrine of Copyright brought about alternative movements such as Copyleft, which tries to establish limits to the excessive protection given to Copyright, weighing it against the need of access to education, knowledge and culture.
