Legal and philosophical grounds on the origin and ownership of the first patents of invention

Abstract

This article aims to present some considerations about the origin and legal-philosophical foundations on patents, as unique and temporary privilege granted by the State to the inventor that this reveals the secret of invention; without this guarantee hardly the inventor reveal the invention, keeping it secret. The basic principle on patents is the socialization of knowledge through the detailed description of the invention, enabling technology development, while also rewarding the inventor for novelty, inventive step and industrial application, offering you a unique and temporary privilege to be able to exploit it economically by a time gap, the minimum of 10 and maximum of 20 years by the current Brazilian Industrial Property Law of excluding others, but after falling into the public domain.
