Recommendation no. 193/2011: opinion on Bill 547/2011, amending Law 11.540/2007 on the National Fund for Scientific and Technological Development

Abstract

Opinion issued in the Intellectual Property Committee of the Brazilian Bar Institute (IAB) on Recommendation no. 193/2011, whose object is Senate Bill 547/2011. The document reports the handling of the recommendation within the IAB since 2011 and the progress of the bill in the Senate, and examines the merits of the amendments proposed to Law 11.540/2007, which governs the National Fund for Scientific and Technological Development. It analyses the provisions clarifying that interest, amortisation and securities income are to revert to the fund, the change from a ceiling of 25% of budget appropriations to a floor for reimbursable investment, and the new paragraph capping at 50% the resources allocated to reimbursable funding and equity participation, in defence of basic research. The opinion concludes for the approval of the recommendation and for full endorsement of the bill with the amendment proposed by the rapporteur in the Senate.
