The social function of intellectual property and the role of technological innovations in realizing access to health

The main objective of this scientific research is to investigate the social function of intellectual property and its real reach in achieving access to health through technological innovations. Comprising three (3) sessions, it will address important (inter)national aspects of the right to health as a human rights matrix, linking technological innovations in the medical field and the role of property protection systems in the realization of this right. As a legal scenario used, among others, the 1988 Federal Constitution stands out, since it includes the right to health as a social right, to determine that intellectual property must have a social function, as well as to encourage and promote scientific development and research. In order to achieve the main objective of this research, it was necessary to systematize intellectual property, revising its national and international legal basis, principles, elements and historical context, in order to understand how the social function of this institute can be useful in the concretization of a social right. It should be mentioned that the purpose of this research, which is eminently descriptive, is to critically consider the phenomenon of access to health from the perspective of technological innovations and intellectual property.
