Law and intellectual property: constitutionalization, field of action and liability for infringement of the right

Abstract

This work is part of a chapter of the undergraduate final paper in Law entitled Intellectual Property and the different forms of protection: perspectives of legal support and of practice, whose purpose is to study the institute of intellectual property, its system of protection, its influence on the various fields of law and the relation of law to intellectual property. As regards the research proposal, the object of study is the institute of intellectual property and the way in which it is legally supported, through research in diverse and up-to-date sources. The following problem is therefore posed: what important contributions can intellectual property offer, both to society and to the scientific field and to professional practice? The research methodology is based on bibliographic research and the method used is narrative literature review, this being a qualitative and descriptive study. It was possible to perceive a considerable doctrinal and case-law dispute as to the object researched and its system of protection. It was also possible to detect the relevant importance of this institute for social, economic and cultural advancement and the perception of a hybrid body of study and knowledge that runs across several fields of practice and domain beyond law.
