This article will examine the effects of standards in the advancement of biotechnology in the Brazilian legal system in the face of transgenic / food security and Intellectual Property Law. Urgent the question of food as a fundamental guarantee of human dignity ratified the Declaration of Human Rights. The clash of socio environmental politics with regard to food security is of global significance, observed since the dawn of civilization to the use of rudimentary techniques and handling of seed. Throughout the biotechnological enhancement comes the need to restrain potential abuses in scientific search instrumentalization contents in cultivars, printing to the National Legislation and International regulation of public and private institutions in the representativeness and biotechnology projection scenery.
