Abstract

The overlapping of intellectual property rights is a question common to all the institutions protected by these rights and is the object of studies and discussions in Brazil and abroad, still without a solution or alternatives for reconciliation. Particularly in the field of pharmaceutical patents, it is pertinent to analyse the deleterious consequences for public policies on access to medicines when the patent system is frustrated by the right to confidentiality and to the exclusive use of clinical trial data.
