Abstract

The article deals with the ethical and legal questions raised by the advance of biotechnology, addressing several aspects concerning the protection of intellectual rights, genetic research and diagnosis, and cloning. It situates the protection of intellectual rights within Law No. 9,279/1996, Law No. 9,610/1998 and Law No. 9,456/1997, in addition to the international agreements on the matter, and examines the rights relating to medicines, genetic tests and diagnoses, and the cloning procedure. It discusses the disposal of the materials used in research, the benefits attributed to genetic treatments, confidentiality, access to the natural resources of biodiversity and the participation of the countries where those resources are found in the research and in its results. It holds that the extraction of natural resources must be sustainable, that debate on such subjects as genetic patenting and cloning must be broadened, and that the protection of investments must be calibrated so as not to become detrimental to the human being, encouraging genetic research through criteria that afford security to researchers, funders and the population.
