Resumo

O presente artigo busca elucidar a interpretação constitucional, que deu respaldo jurídico à criação do Primeiro e Segundo Banco dos Estados Unidos. Analisando o programa econômico de Alexander Hamilton e suas postulações pela constitucionalidade da instituição, bem como a inicial tramitação no congresso americano e a decisão pela constitucionalidade da instituição financeira, emanada pela Suprema Corte durante a Presidência de John Marshall, o trabalho busca mostrar que a teoria dos poderes implícitos fora essencial para que o Banco dos Estados Unidos fosse criado e mantido, dando assim respaldo legal e constitucional ao programa econômico de Hamilton, que seria responsável pelo surpreendente crescimento econômico dos EUA durante o século XIX.
